Legal Distance between two Borewells - Chittoor(D.t),G.D.Nellore (M.D) Area
I am Resident of Varathur panchayat, G.D.Nellor (M.D) & Chittoor D.t
We have bore well at my residence purely used for agricultural purpose, which we had drilled aprox in year of 1998. Over the year so many bore wells were drilled around our point, which includes a public standpost too.
In the year 2009 we have drilled one more Borewell after stoppage of water from old well , just 2-3 mt away from old one.
After almost 10 months, water is not coming from public bore well and there are claming that there is a linkage between ours and public drinking bore well.
when public bore well was drilled we suggestd them to not to make near by ours, However due this are many our bore well got dried, which made us to drill new one.
Public is asking us to close our bore well, so that sufficient water will be available for drinking purpose.
Please suggest what the legal distance between two bore wells and also suggest how to come out-of the problem.

THE MINIMUM DISTANCE BETWEEN TWO BOREWELLS SHOULD BE AT LEAST BETWEEN 300-500 FEET. 500 FEET IS THE BETTER OPTION.

2. There is no law to prescribe
There is no law to prescribe any minimum distance between two borewells. And there are several reasons why such a law is impractical. First, it would give unlimited freedom to the person who makes the well first, and put restrictions only on the person who makes it afterwards. This is against concepts of natural justice. It could lead to such absurdities as people rushing to make a nominal 5 foot hole to claim "I made it first". Second, the minimum distance will depend on the type of aquifer and it is a herculean task to map the aquifer parameters everywhere and even if that was done one of the parties would contest it, leading to indefinite litigation. Third, the proposed minimum distance would also depend on intended extraction. The minimum distance for two wells using 10 HP pump would be much more than the minimum distance for 1 HP pumps. If you claim my well is too close to yours, I would ask you to replace your pump with a smaller one. Fourth, in some cases, particularly the residential plots, the minimum distance would take the next closest borewell outside the plot boundaries of adjacent plots, virtually denying any borewell to them.
The issue is not the distance between two borewells, but how much quantum of water each of them extracts. Presently the law permits any one to extract any amount of water. If we want some law and order in GW management, the society will have to accept laws that restrict the quantum of water that can be extracted. However, defining such restrictions is an extremely difficult task. It is in the domain of what is known as defining “water entitlements”. Determining such “water entitlements” will require a huge internal debate within the society. Presently, this debate has not even started because presently the society has been lead in to believing that the problem of ground water is “less recharge”; and the problems can be solved by increasing the recharge. Therefore, all focus is only on increasing the recharge by rainwater harvesting. Unless we understand that the real problem is “too much extraction”, the GW management will continue to be in a state of anarchy.
